In re Brandon J. Raub

Dear Mr. Davenport:

We the undersigned do hereby demand that you prosecute for kidnapping and criminal assault all public officials, local state and federal, involved in the unlawful interrogation, arrest, detention and involuntary commitment of Brandon J. Raub to two psychiatric facilities, the planning of which began in conspiracy with Federal agents and officials sometime before August 16 and continued until he was released by Hopewell Circuit Court Judge W. Allan Sharrett on August 23, 2012.

Neither the Commonwealth of Virginia nor the United States Government put forth any allegation or legal basis for interrogating, arresting or detaining Mr. Raub or for committing him to psychiatric wards and submitting him to threats of psychotropic drugs and brainwashing by government psychiatrists.  Yet, Commonwealth and Federal agents unlawfully interrogated him without administering a Miranda warning, did violence upon his person by handcuffing him and wrestling him into a police car against his will, held him in custody for a week without charging him and forcibly committed him, subjecting him to threats of bodily and mental harm under the guise of an involuntary mental evaluation, all without charging him with any crime or wrongdoing or charging that he was in any way mentally impaired or incompetent or a danger to himself or other people.

The Commonwealth of Virginia and some of its legal sub-jurisdictions actively participated in a well-coordinated criminal conspiracy with federal officials to kidnap, do violence upon his person, make threats to his health and safety, detain and spirit Mr. Raub into a psychiatric ward against his will, all criminal acts and in direct violation of Mr. Raub’s constitutional rights.  These horrific actions are reminiscent of the old Soviet Union and so contemptible that Mr. Jefferson must be turning in his grave.  Is this the New Virginia Way?

As the law-enforcement officer of the Commonwealth of Virginia for Chesterfield County responsible for prosecuting crimes, you are compelled to investigate and bring to justice all individuals involved in these criminal acts.  At a minimum, you must present this case to the Grand Jury for its consideration.  Moreover, because it is unambiguously clear that these actions were taken as the direct result of an organized criminal conspiracy among Virginia and federal officials, you also are obliged to bring racketeering charges against all the people involved in the incidents under the “Virginia Racketeer Influenced and Corrupt Organization (RICO) Act.”

Finally, these incidents and this conspiracy between Virginia and federal officials are so outrageous and contrary to the precepts of American and Virginian justice that we demand that you release to the public all information in your possession related to the incidents that occurred, including communications among Virginia agencies and personnel, both among themselves and with federal officials, as per our Freedom of Information Act request previously submitted to you on September 6, 2012 (http://revolutionpac.com/press/freedom-of-information-act-request-william-w-davenport-commonwealth-s-attorney-chesterfield-county).

As Commonwealth’s Attorney, you must not put Virginia and federal officials above the law by exempting them from responsibility under any abstract claim of so-called “sovereign immunity.”  Nor may you shield the criminal actions of public officials behind a civil-commitment process that has been abused to circumvent constitutional rights and avoid due process of law.  In America, all people are created equal under the law, including local, state and federal officials, and all must be held to account equally before the law.
